Terms of Service

1. Agreement

By accessing and using JCM Global Carrier's website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Service Description

JCM Carrier provides carrier brokerage and connectivity services including Link Dedicado, IP Transit, DIA Enterprise, L2 Transport, Last Mile Access, and Cross-Border Connectivity. Services are provided on an as-is basis subject to availability and regulatory compliance.

3. Service Level Agreements (SLA)

Our services include SLA guarantees as follows:

• Standard Services: 99.9% uptime SLA with automatic compensation for breaches
• Enterprise Services: 99.99% uptime SLA with enhanced support
• SLA excludes scheduled maintenance, force majeure, and customer-caused issues
• Compensation calculated as service credit against future invoices

4. Pricing and Billing

Pricing is provided in quotes and subject to acceptance. We support billing in USD, EUR, and BRL. Invoices are due within 30 days unless otherwise agreed. Late payments may incur interest at 1.5% per month.

5. Term and Termination

Service agreements are typically 12 months with automatic renewal unless terminated with 30 days' notice. Either party may terminate for material breach if not cured within 15 days of written notice.

6. Acceptable Use

You agree not to:

• Use services for illegal activities or violate applicable laws
• Conduct DDoS attacks or network abuse
• Resell services without authorization
• Interfere with network operations or security
• Transmit malware or harmful content

7. Limitation of Liability

JCM Carrier's total liability shall not exceed the fees paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages including lost profits or data loss.

8. Indemnification

You agree to indemnify and hold harmless JCM Carrier from claims arising from your use of services, violation of these terms, or infringement of third-party rights.

9. Intellectual Property

All content on our website, including text, graphics, logos, and software, is owned by JCM Carrier or licensed partners. You may not reproduce or distribute without permission.

10. Governing Law

These Terms are governed by the laws of Brazil. Any disputes shall be resolved in the courts of São Paulo, Brazil.

11. Changes to Terms

We reserve the right to modify these terms at any time. Changes become effective upon posting to the website. Continued use constitutes acceptance.
